Shanghai Free Trade Port Is Constructed under the Rule of Law
【Abstract】
This issue of Key Reference publishes an article entitled Shanghai Free Trade Port Is Constructed under the Rule of Law. This article analyzes that under the background of promoting the rule of law, as a pioneering area to explore the construction of a free trade port, Shanghai must pay special attention to the rule of law in construction Shanghai Free Trade Port, and maintain, guarantee, and consolidate the advanced experience and achievements of opening-up through the legal mechanism. The article further analyzes that during the exploration and construction of the free trade port, Shanghai shall apply to the central government to authorize Shanghai Municipal People's Congress and the Standing Committee to formulate relevant legal systems for free trade ports, in a bid to create a regulatory system in line with the highest standards, and summarize and publish the "list of regulations" and the "list of services" within the port area. For example, in terms of inspection and quarantine, Shanghai Free Trade Port can be built as a pioneering area to use international standards in China. The exploration and construction of the free trade port shall also focus on the supply of the rule of law, and strengthen the capability and attractiveness of domestic judicial institutions and arbitration institutions in solving international commercial disputes. For example, under the effective supervision of judicial authorities, free trade ports could build diversified dispute resolution centers in cooperation with the CCPIT and other organizations, in order to provide diversified, convenient, and efficient dispute resolution services, and vigorously enhance the judicial service support capability of free trade ports.
